So they have "no immediate" plans to sue. Unfortunately that could mean anything. Personally I'm all in favour of Microsoft attempting to sue. It will finally shut them up (anyone remember SCO???). There was an interesting piece on Grocklaw when this all kicked off, PJ put the point forward that once you know about a patent infringement you have to act on it. You can't wait until it makes you the most money, doing this is against the "spirit" of patent law and renders your claim void. I think this needs a company like Red Hat to bring an action against Microsoft to say in essence "put up or shut up". At the present Microsoft occasionally pull the "you've got our IP" card out of the bag just to give Linux a bad run in the press.
